Democratic Senators Pass Torch to EPA on Climate Change

After years of trying?and failing?to get climate-change legislation through Congress, top Senate Democrats are publicly ready to hand over the power to President Obama and the Environmental Protection Agency.

?A lot of people don?t recognize that EPA has huge authority to reduce carbon in the air,? Senate Environment and Public Works Committee Chairwoman Barbara Boxer, D-Calif., said at a briefing Tuesday.

?A lot of you press me ? on: ?Where is the bill on climate change? Where is the bill?? There doesn?t have to be a bill,? Boxer told a group of reporters in her office in the Hart Senate Building. ?There will be many approaches, but I?m telling you right now, EPA has the authority in the transportation sector, in the electricity sector, and the industrial sector under the Clean Air Act.?

Boxer?s public comments come a few months after another top Democrat, Senate Democratic Policy and Communications Center Chairman Chuck Schumer of New York, made similar comments to another group of reporters shortly after the election in November. Speaking at a Christian Science Monitor breakfast, Schumer noted the significance of EPA?s authority to regulate greenhouse-gas emissions and said that Congress could instead tackle smaller bits of policy, such as energy-efficiency legislation.

The statements by Boxer and Schumer that they won?t push big climate legislation and will defer to EPA on global warming are two of the clearest signals yet that the Democratic Party will not only defend the agency?s authority to regulate carbon emissions but that it will also follow through on the regulations, despite Republican criticism and industry pleas to slow down the rules. Boxer?s statement also came on the heels of Obama?s Inaugural Address, where he gave a full-throttled call to action on climate change.

After spending the past two years fighting over EPA and casting messaging votes on the agency?s carbon rules, Congress is poised for even more intense partisan clashes. This year?s fights will carry more weight as the agency gets closer to rolling out the regulations that will affect coal-fired power plants across the country. Senate Majority Leader Harry Reid, D-Nev., ensured during the last congressional session that no GOP-led efforts to pass legislation delaying or eliminating EPA?s climate rules can succeed. Boxer is confident Senate Democrats can beat back expected GOP efforts this Congress, too.

?We will stop it every time, let me just tell you that,? Boxer said.

A 2007 ruling from the Supreme Court is backing Boxer up. Republicans?with potential support from some moderate Democrats up for reelection in 2014?will nonetheless put up a big fight. Sen. James Inhofe, R-Okla., who has been the ranking member on the Environment and Public Works Committee during Obama?s first term, and GOP leadership in the House have vowed to keep trying to curtail EPA on a whole host of issues, especially climate change. A request for comment to the Environment panel?s new top Republican, Sen. David Vitter of Louisiana, was not returned.

After unveiling its new BlackBerry World app hub (music and video still incoming), its dev blog has now announced that RIM will be extending its Built for BlackBerry scheme. Intended to draw in even more native apps for its new mobile platform, the final cut-off date has now been moved from January 21st to February 18th. Talking to German paper, Die Welt, CEO Thorsten Heins recently backed up claims that BlackBerry's new OS would launch with 70,000 apps, although we all know that quality trumps quantity -- something that RIM aims to address. If devs submit an app that makes over $1,000 but less than $10,000, the Waterloo phonemaker will fork out the difference -- app authors can also submit their programs for approval without charge. Japan talk of warning shots heats up China dispute

TOKYO (AP) ? Japan says it may fire warning shots and take other measures to keep foreign aircraft from violating its airspace in the latest verbal blast between Tokyo and Beijing that raises concerns that a dispute over hotly contested islands could spin out of control.

Japanese officials made the comments after Chinese fighters tailed its warplanes near the islands recently. The incident is believed to be the first scrambling of Chinese fighters since the tensions began to rise last spring.

According to Chinese media, a pair of J-10 fighters was scrambled after Japanese F-15s began tailing a Chinese surveillance plane near the disputed islands in the East China Sea. China has complained the surveillance flight did not violate Japanese airspace and the F-15s were harassing it.

It was the first time the Chinese media has reported fighters being mobilized to respond to Japanese air force activity in the area and comes amid what Japan says is a rapid intensification of Chinese air force activity around the islands, where Japanese and Chinese coast guard ships have squared off for months.

Though there have been no outright clashes, the increased sea and air operations have fueled worries that the situation could spin out of control.

Such concerns have grown over official comments suggesting new Japanese Prime Minister Shinzo Abe and his Cabinet are considering the use of "tracer" fire as a means of responding to airspace incursions. Tracer rounds are designed to burn brightly to get the attention of a pilot who may have missed other warnings due to a radio malfunction, while also indicating that the aircraft firing them is prepared to take further action.

"Every country has procedures for how to deal with a violation of its territory that continues after multiple cautionary measures," Japanese Defense Minister Itsunori Onodera said Wednesday when asked if tracer shots would be fired against intruding aircraft that refuse to change course. "We have response measures ready that are consistent with global standards."

Onodera said the use of warning shots has long been provided for under Japan's defense policies and is widely accepted under international rules of engagement. Japan's air force has not actually resorted to them since 1987 ? against a Soviet aircraft ? and none were fired last week.

But Chinese and Japanese media have suggested Tokyo is publicly floating the possibility to test China's reaction.

The escalation of tensions has worried the United States, with Secretary of State Hillary Rodham Clinton saying Friday that while the U.S. doesn't take a position on who has sovereignty over the islands, it opposes "any unilateral actions that would seek to undermine Japanese administration."

That brought a sharp retort from the Chinese Foreign Ministry on Sunday. The comments "ignore the facts" that the islands are China's inherent territory, spokesman Qin Gang said in a statement that urged the U.S. to adopt "a responsible attitude."

In Beijing last week, a Foreign Ministry spokesman said China is on "high alert" and suggested Japan is escalating the tensions over the islands, called the Diaoyu in China and the Senkaku in Japan. Taiwan also claims the small isles, which are uninhabited but may be surrounded by valuable underwater natural resources.

"Chinese planes and ships are exercising normal jurisdiction in the waters and airspace surrounding the Diaoyu Islands," spokesman Hong Lei said. "We are opposed to the operations of Japan's planes and ships, which violate our rights around Diaoyu. We are on high alert against this escalation."

As is often the case, Chinese media quoted military academics with a much more fiery response.

"Japan's desire to fire tracer warning shots as a way of frightening the Chinese is nothing but a joke that shows the stupidity, cruelty and failure to understand their own limitations," Maj. Gen. Peng Guangqian of the Chinese Academy of Military Sciences was quoted as saying by the China News Service and other state media.

"Firing tracer bullets is a type of provocation; it's firing the first shot," he said. "Were Japan to dare to fire tracers, which is to say fire the first shot, then China wouldn't stint on responding and not allow them to fire the second shot."

Peng said Japan may have put out the report to generate discussion and gauge China's response.

LONDON (AP) -LONDON (AP) - Clint Dempsey scored a second crucial goal of the season for Tottenham against Manchester United on Sunday, striking deep into stoppage time to secure a 1-1 draw against the Premier League leaders.

The United States forward, who gave Tottenham its first win at Old Trafford in 23 years in September, gave the hosts something to show for their dominance by canceling out Robin van Persie's first-half header.

"It looked like it was going to be one of those days but I am happy we got a point," said Dempsey, who joined from Fulham in August.

Dempsey swept the ball home in the third minute of stoppage time after being set up by Aaron Lennon, who had pounced after goalkeeper David de Gea only punched a shot by Benoit Assou-Ekotto.

The game was played under a steady snowfall and was in danger of being postponed before officials determined that the pitch was playable.

The four points Spurs have claimed off United this season is the most since beating them twice in the 1989-90 campaign.

Despite salvaging a point, Tottenham fell four points behind third-place Chelsea after its London rival beat Arsenal 2-1 earlier in the day.

United remains top but its lead has been trimmed to five points this weekend after second-place Manchester City beat Fulham 2-0 on Saturday.

"We should have killed them off on the counter-attack in the second half," United manager Alex Ferguson said. "It was the final ball that was letting us down. It was a difficult tie, teams will drop points here, there is no doubt about that."

United, though, rarely threatened Tottenham goalkeeper Hugo Lloris after Van Persie rose to meet Tom Cleverley's cross and head in his 22nd goal of the season in the 25th minute.

As well as ruing his team's lack of ruthlessness in front of goal, Ferguson turned his fury on assistant referee Simon Beck for not awarding a penalty after substitute Wayne Rooney was caught by Steven Caulker in the second half.

"It was definitely a penalty - he has put his leg right in there," Ferguson said. "The linesman is facing it. I thought he had a very poor game, the linesman. I thought he was disappointing.

"We have got that history with him. He never gave offside with (then-Chelsea striker Didier) Drogba at Old Trafford (in 2010) when he was three yards offside. Everyone remembers that. I certainly do."

But United had been heavily reliant on center backs Rio Ferdinand and Nemanja Vidic, as well as De Gea's blocks, to protect its lead.

"We dominated the whole game, played well and deserved to win to be fair," Tottenham manager Andre Villas-Boas said. "We had 60 per cent possession against United, 15 shots against four and should have won.

"Champions like United have to go through moments like this but I think we deserved this last-minute goal."

In ComReal Miami?s year end report for 2011, we wrote about the ?return of the landlords? and about the announcements of speculative construction for several, new warehouse projects. In 2012, the theme was absolutely ?breaking ground!? as eight new projects commenced. It was very good to see vertical construction in Miami occur once again. ComReal reports that the total amount of warehouse space that was completed and/or nearly-completed in 2012 was about 2,200,000 sq. ft. In addition, new warehouse buildings are going to be constructed in 2013 in Beacon Lakes, Flagler Station, Miami International Tradeport, Airport North Industrial Park, South Florida Logistics Center and Miami International Logistics Center. This year we can expect to see more new construction, some in-fill developments, some re-developments of existing warehouses plus even some demolitions of older, non-functional buildings.

In comparison to the end of the year in 2011, 2012 ended with slight increases to both the average sales price and lease rate; $64 per sq. ft. and $7.54 per sq. ft. respectively. The vacancy rate dropped from 7.9% to 6.7%. Although the positive absorption was only 2,080,000 sq. ft. (down from 2,508,000 sq. ft.), that is a very good sign considering that we had new warehouse space delivered to the market.

The grand finale of the year, was the late-December closing on 45 acres located at 7500 NW 82nd Place in Medley by L&B Realty Advisors. The price was $45,000,000 or about $11.75 per sq. ft. plus the cost of the additional site work that will be needed. Butters Construction & Development will be constructing over 900,000 sq. ft. of warehouse space for what is now being branded as Airport North Industrial Park.

Miami continues to be one of the most dynamic markets in the entire country. No city in the USA may benefit more than Miami from the Foreign Trade Agreements (FTA?s) and Foreign Trade Zones (FTZ?s) thanks in part to the U.S. Department of Commerce. The federal, state and local investments to our infrastructure and transportation systems will secure the foundation for developing our overall industrial real estate market.
